1.《关于新冠肺炎疫情防控期间加强和规范在线诉讼工作的通知》发布


Notice Released Regarding Strengthening and Regulating Online Litigation During the Period of Prevention and Control of COVID-19


2020年2月18日, 最高人民法院发布《关于新冠肺炎疫情防控期间加强和规范在线诉讼工作的通知》。


On February 18, 2020, the Supreme People’s Court issued the Notice Regarding Strengthening and Regulating Online Litigation During the Period of Prevention and Control of COVID-19 (hereinafter the ‘Notice’).


《通知》明确了在线诉讼有关规则。一是规范在线身份认证,确保各方诉讼参与人身份真实性,实现“人、案、账号”匹配一致;二是规范网上立案,要求人民法院应当在收到在线立案申请后七日内进行审核,对符合法律规定的,及时登记立案;三是大力促进在线调解,要求各级人民法院依托在线矛盾纠纷多元化调解平台,加大疫情防控期间矛盾纠纷化解力度;四是规范诉讼材料提交当事人通过电子化方式提交诉讼材料的,经人民法院审核通过后,可以不再提交纸质原件。人民法院应当为当事人提交电子化材料提供平台支撑和技术便利;五是规范在线庭审,要求各级人民法院综合考虑技术条件、案件情况和当事人意愿等因素,确定是否采取在线庭审方式,并明确不适用在线庭审的具体情形;六是规范在线裁判,允许具备相应条件的法官远程查阅电子卷宗、合议案件、撰写提交裁判文书等;七是加大电子送达适用力度,明确电子送达的适用条件、送达方式和生效标准;八是加强在线诉讼服务,要求人民法院全面升级在线诉讼服务平台,拓展在线诉讼服务功能。


The Notice clarifies the rules on online litigation. The first rule regards regulation of online identity authentication to ensure the authenticity of the identities of parties involved in litigation, and to achieve a consistent match of  ‘person, case, and account number’. The second rule regards regulation of online filing, which requires the people’s court to conduct an examination within seven days of receiving the online filing application, and to timely register files that comply with legal requirements. The third rule regards the promotion of online mediation, which requires people’s courts at all levels to strengthen the degree of resolution of contradictions and disputes during the period of epidemic prevention and control, relying on online multi-media mediation platform for contradictions and disputes. The fourth rule clarifies ruling of submission of case materials. Where a party submits case materials through electronic means, they may not need to submit the original paper after review and approval by the people's court. The people’s court should provide platform support and technical convenience for parties submitting electronic materials. The fifth rule regards regulation of online hearings. It requires courts at all levels to comprehensively consider factors such as technical conditions, situation of cases and parties’ willingness, to determine whether or not to hear a case online. Circumstances under which an online hearing would not be suitable should be clarified. The sixth rule regards the standardization of online decision making and judging. The Notice allows judges with corresponding conditions to remotely access electronic dossiers, remotely take collegial deliberation, as well as to remotely write and submit decisions and judgments. The seventh rule regards the enhancement of electronic delivery, and explication of applicable conditions, delivery methods and effective standards for of electronic delivery. The eighth rule regards enhancement of online litigation services, which requires the people’s courts to fully upgrade online litigation platforms and expand the functions of online litigation services.

近日,最高人民法院下发《关于认真贯彻落实中央全面依法治国委员会第三次会议精神 切实做好防控新型冠状病毒感染肺炎疫情期间审判执行工作的通知》。


Recently, the Supreme People’s Court issued the Notice on Effectively Implementing the Sprit of the Third Meeting of the Central Comprehensive Law-based Governance Commission and Effectively Strengthening Trial and Enforcement Work During the Period of Prevention and Control of the Outbreak of COVID-19 (hereinafter the ‘Notice’).


《通知》涵盖了刑事、民事、行政、执行、诉讼程序等方面内容。《通知》要求,各地法院暂缓对承担疫情防控任务的单位、人员以及场所、设备、物资、资金采取执行措施,对明确专用于疫情防治的资金和物资,不得采取查封、冻结、扣押、划拨等财产保全措施和强制执行措施,全力保障疫情防控工作。在诉讼程序方面,强调了疫情防控期间该延期审理的案件原则上延期审理,对于符合诉讼中止条件的案件,依法中止审理或执行,对于申请诉讼期间顺延的,要根据实际情况依法充分保障当事人合法权益。对于情况紧急的案件,应当在做好防护措施的前提下开庭审理,有条件的可以采用视频开庭形式。


The Notice involves criminal law, civil law, administrative law, enforcement and legal proceedings, among others. According to the Notice, courts in all localities should suspend enforcement measures for units undertaking epidemic prevention and control tasks, and their personnel, places, equipment, supplies and funds. For the funds and supplies clearly designated for epidemic prevention and control, property preservation measures and mandatory enforcement measures such as impoundment, attachment, freezing, and appropriation should not be taken to make every effort to prevent and control the epidemic. In terms of proceedings, the rules of deferred trial are highlighted. Where a case complies with the conditions for discontinuance proceedings, the trial or enforcement should be suspended. Where a party applies for the postponement of proceeding period, his or her legitimate rights and interests should be fully protected in accordance with law on the basis of fact. For urgent cases, trials should be held under the premise of good protective measures. If necessary, courts may be heard through use of video.

Two Departments Issue Notice to Severely, Heavily and Rapidly Crack Down on Random Price Increases in Prevention and Control Supplies


2月13日,市场监管总局办公厅与公安部办公厅联合印发《关于新冠肺炎疫情防控期间加强价格行政执法与刑事司法衔接工作的通知》。


On February 13, the General Office of the State Administration for Market Regulation and the General Office of the Ministry of Public Security jointly issued the Notice Regarding Strengthening the Linkage Between Administrative Law Enforcement and Criminal Justice During the Period of Prevention and Control of the COVID-19 Epidemic (hereinafter the ‘Notice').


《通知》明确了案件移送的情形利用疫情捏造、散布涨价信息、恶意囤积、哄抬价格的,个人非法经营数额在五万元以上,或者违法所得数额在一万元以上的情形;单位非法经营数额在五十万元以上,或者违法所得数额在十万元以上的情形;其他情节严重的情形,应当将案件移送公安机关。


The Notice specifies the circumstances under which a case may be transferred. Where the epidemic is used to fabricate and disseminate price increase information, maliciously hoard, or drive up prices, if the amount of illegal operation by an individual totals more than 50,000 yuan, the amount of illegal gains of an individual totals more than 10,000 yuan, the amount of illegal operation by an entity totals more than 500,000 yuan, the amount of illegal gains of an entity totals more than 100,000 yuan, or there are other serious acts, the case should be transferred to the public security authorities.


《通知》指出,对哄抬价格违法行为给予行政处罚与依法追究刑事责任并行不悖。市场监管部门向公安机关移送涉嫌犯罪案件前,已经作出的行政处罚决定,不停止执行;向公安机关移送涉嫌犯罪案件时,应当附有行政处罚决定书。未作出行政处罚决定的,原则上应当在公安机关决定不予立案或者撤销案件、人民检察院作出不起诉决定、人民法院作出无罪判决或者免予刑事处罚后,再决定是否给予行政处罚。市场监管部门对应当向公安机关移送的涉嫌犯罪案件,不得以行政处罚代替移送违反规定的,依法追究责任。


The Notice points out that the imposition of administrative punishments for illegal acts of driving up prices is not incompatible with pursuing criminal liabilities in accordance with the law. Before the market regulation authority transfers a suspected criminal case to the public security authority, enforcement of the administrative punishment decision that has been made should not be suspended and a written administrative punishment decision should be attached when a suspected criminal case is transferred to the public security authority. If no administrative punishment decision has been made, in principle, the decision on whether to impose an administrative punishment should be made after the public security authority decides not to file or decides to dismiss the case, the people's procuratorate makes a non-prosecution decision, or the people's court makes a verdict of acquittal or exemption from criminal penalties. For suspected criminal cases that should be transferred to the public security authorities, market regulation authorities can not substitute administrative punishments for such transfer. Violations of provisions should be pursued for liabilities according to the law.

4.两部门:符合条件的新冠肺炎疫情防控殉职人员应评定为烈士


Two Departments: Eligible Personnel Perishing During COVID-19 Prevention and Control Should Be Assessed as Martyrs


2月16日,退役军人事务部、中央军委政治工作部联合印发《关于妥善做好新冠肺炎疫情防控牺牲人员烈士褒扬工作的通知》。


On February 16, the Ministry of Veterans Affairs and the Political Work Department of the Central Military Commission jointly issued the Notice Regarding Properly Honoring Personnel Perishing During COVID-19 Prevention and Control (hereinafter the ‘Notice').


通知指出,在新冠肺炎疫情防控工作中,直接接触待排查病例或确诊病例,承担诊断、治疗、护理、医院感染控制、病例标本采集、病原检测以及执行转运新冠肺炎患者任务等的医务人员和防疫工作者因履行防控工作职责感染新冠肺炎以身殉职,或者其他牺牲人员,符合烈士评定(批准)条件的,应评定(批准)为烈士


The Notice points out that during prevention and control of COVID-19, health care workers and epidemic prevention workers who have died following being infected with COVID-19 during their performance of duties of prevention and control, such as having direct contact with cases to be investigated or confirmed cases, undertaking diagnosis, treatment, care, hospital infection control, collection of case specimens, detection of pathogens, and performing the task of transferring patients with COVID-19, or other personnel who die should be assessed (approved) as martyrs when meeting the conditions for martyrs assessment (approval).


根据通知要求,参加疫情防控工作的地方人员根据《烈士褒扬条例》规定评定,各地统一组织赴湖北的医疗救援人员牺牲的,由派出人员单位所在地省级人民政府评定;参加疫情防控工作的军队人员和军队聘用的社会人员,由军队相关部门根据有关规定批准。


According to the requirements of the Notice, local personnel participating in epidemic prevention and control are assessed according to the Regulations on Honoring Martyrs. If the medical rescue personnel organized by each locality to go to Hubei perish in the line of duty, they should be assessed by the provincial people's government of the places where the dispatched personnel’s units are located. Military personnel and social personnel employed by the military participating in epidemic prevention and control should be approved by the relevant military departments in accordance with relevant provisions.

5.民政部:慈善组织、红十字会要加快工作节奏


Ministry of Civil Affairs Requires Charities and Red Cross to Speed up Work


2020年2月14日,民政部社会组织管理局、慈善事业促进和社会工作司发布《 慈善组织、红十字会依法规范开展疫情防控慈善募捐等活动指引》。


On February 14, 2020, the Administration of Social Organization and the Department of Charities Promotion and Social Work of the Ministry of Civil Affairs jointly issued the Guidelines on Charity Fundraising and Other Activities Conducted by Charities and the Red Cross for Epidemic Prevention and Control according to Laws (hereinafter the ‘Guidelines’).


《指引》强调,慈善组织、红十字会应合理分配使用捐赠款物。除定向捐赠外,重点支持湖北省特别是武汉市等疫情严重地区。同时,慈善组织、红十字会要加快工作节奏,建立快速便捷的分配通道,按照各地联防联控机制的要求,与疫情防控定点诊疗医院等接收单位有效对接,做到“快进快出、物走账清”,第一时间将捐赠款物送到疫情防控工作一线,防止捐赠款物积压。


The Guidelines stress that charities and the Red Cross should reasonably allocate and use donated funds. Focus should be placed on Hubei Province, especially Wuhan and other severely affected areas, except in the case of targeted donations. Meanwhile, charities and the Red Cross should speed up the pace of work, establish fast and convenient distribution channels, effectively connect with designated diagnosis and treatment hospitals for epidemic prevention and control and other receiving entities in accordance with the requirements of joint prevention and control mechanisms in all places to ensure that the donated funds and supplies are received and allocated fast, the account records are clear, the donations are sent to the front line of epidemic prevention and control as soon as possible, and the backlog of donations is prevented.


根据《指引》,慈善组织、红十字会接收的定向捐赠物资,应按捐赠人意愿委托送达或由捐赠人直接送达最终使用单位。对于可以直接送达最终使用单位的非定向捐赠物资,由慈善组织、红十字会协调捐赠人直接送达最终使用单位或指定地点。


According to the Guidelines, targeted donations received by charities and the Red Cross should be delivered as entrusted by the donors or directly by the donors to the final receiving entities. And non-targeted donations which can be directly delivered to the final receiving entities should be directly delivered to the final receiving entities or designated places after the charities and the Red Cross coordinate with the donors.


此外,《指引》明确,不允许捐赠人以定向捐赠的名义指定其利害关系人作为受益人


In addition, the Guidelines clarify that donors are not allowed to designate their interested parties as beneficiaries in the name of targeted donations.

6. 财政部:严禁“搭便车”购置与疫情防控无关资产


Ministry of Finance Strictly Prohibits “Hitchhiking” Purchase of Assets Not Related to the Epidemic Prevention and Control


2月14日, 财政部发布《关于做好新冠肺炎疫情防控资产保障工作的通知》。


On February 14, the Ministry of Finance issued the Notice Regarding Adequate Asset Guarantee for the Epidemic Prevention and Control of COVID-19 (hereinafter the ‘Notice’).


《通知》要求,各部门、各地方要指导行政事业单位建立疫情防控资产登记台账,完善疫情防控资产的验收、保管、领用、报损制度,明确责任人,确保资产安全完整、流向可查。加强资产管理部门与采购管理、预算管理、财务管理等部门的协调对接,按规定入账。


According to the Notice, all departments and localities should guide administrative and public institutions to establish registration ledgers for assets of epidemic prevention and control. They should also improve the systems for the acceptance, storage, receipt and use and loss reporting for the epidemic prevention and control assets, determine responsible persons, as well as ensure that assets are safe, complete and checkable. Asset management departments should strengthen the coordination and connection with procurement management, budget management, financial management and other departments, and records should be made in accordance with regulations.


《通知》强调,各级财政部门会同主管部门加强对行政事业单位疫情防控资产管理的监督检查,严禁“搭便车”购置与疫情防控工作无关的资产,避免国有资产损失和浪费对于违规违纪违法操作,造成不良影响和国有资产流失的,由相关部门按照有关规定追究责任。


The Notice emphasizes that financial departments at all levels, together with competent authorities, should strengthen the supervision and inspection of the management of the epidemic prevention and control assets by administrative and public institutions, and strictly prohibit the “hitchhiking” purchase of assets not related to the epidemic prevention and control to avoid loss and waste of state-owned assets. Anyone who has any illegal operation in violation of regulations, disciplines and laws that cause bad effects and loss of state-owned assets should be held accountable by relevant departments.
